Drunk Near A Car, Ohio’s Physical Control Law

The best example of a Physical Control violation is the person who stumbles out of the bar and decides to “sleep it off” in their vehicle.  Often times what happens is the person starts the car, either to run the air conditioner or the heater, so the vehicle is actually running, then goes to sleep.

Unfortunately, one need not have the car running or even have the keys in the ignition in order to be in violation of O.R.C. 4511.194, Ohio’s Physical Control law. Under the Ohio Physical Control statute, having the keys within reach will satisfy the definition of having “physical control.”   The physical control statute was essentially designed to “reward” or rather, not punish as severely, the person who drinks too much (or uses drugs of abuse) and then gets into their car, but decides not to actually drive. In some other states, driver’s are offered a “safe harbor” defense if they decide to pull over and run the car so as not to freeze to death.

Bushatz -A client of mine recently alerted me to a telephone scam.  Someone calling from a scrambled number claims to be from a reputable payday lender and claims that you owe a certain amount of money.  They ask for personal information or threaten that the police are going to come and take you to jail or court if they do not receive the money they claim they are owed.  The people calling usually have a foreign accent that sounds Indian and claim their name is Mike Jones or some other common name.  This is a scam on several levels.  The scammers get information about people who have applied for loans or other financing on the internet, where they can glean a massive amount of information – including social security numbers, bank accounts, employers and references.

The way they are trying to intimidate people – by threatening to have the police come and take them to court or jail – is simply a way to scare people into giving valuable information or paying money to these scammers.  The truth is we don’t lock people up for failing to pay their bills; we no longer have debtor’s prisons.  Further, if this were legitimate, a person would receive some sort of correspondence from a court that has jurisdiction that there is a suit against them for their unpaid bills.  A person calling up claiming you owe them money without legitimately proving the debt exists is a scam that the Consumer Protection Agency knows about.  Unfortunately, there is little to be done with these scammers as they are operating in another country and appear to be outside the enforcement of the US Government.

Miamisburg Municipal Court

If you are arrested for OVI in Miamisburg, West Carrollton, the Village of Germantown, Miami Township or German Township, your OVI case will be heard in the Miamisburg Municipal Court.  All misdemeanor cases originating in the territorial jurisdiction of Miamisburg Municipal Court are processed through the court and remain there until sentencing or until redirected to a higher court such as the Montgomery County Common Pleas Court. Miamisburg Municipal Court also facilitates probationary procedures for the entire jurisdiction.

Oakwood Municipal Court

Oakwood, Ohio is served by the Oakwood Municipal Court (click here for link to the Court).  The Oakwood Municipal Court hears all misdemeanor cases, arraignments and traffic violations, as well as preliminary hearings on felony cases. The court also hears small claims and civil cases.  Most cases are heard on Thursday mornings beginning at 8:30 a.m., and trials are usually held on Friday.

If you are arrested for OVI in Oakwood, you will appear in the Oakwood Municipal Court, 30 Park Avenue , in Oakwood’s Municipal Building.  Hearings and trials are held in the same chamber wherein the council meetings are held.  Questions about the court should be directed to the Clerk of the Oakwood Municipal Court at 293-3058.  The Clerk of Courts Office is open 8-5 Monday through Friday.
