Extra Patrols In Montgomery County Throughout New Year Holiday

The Ohio State Highway Patrol has announced that it is doubling its forces on Saturday to combat drunk drivers during the New Year’s Eve holiday.  According to WDTN,  [see here] Troopers will be focusing on areas like Harrison Township, Butler Township and the Dayton Mall area.  Not coincidently, these areas are the areas frequently targeted for checkpoint enforcement.  No announcements of OVI checkpoints have been made.  Other announcements from the Ohio State Highway Patrol have indicated that 80 Ohio jurisdictions are participating in the “Drive Sober or Get Pulled Over” campaign and will have extra patrols throughout the New Year holiday weekend.

Kettering DUI Sting Set For Tonight (Dec. 30th)

Tonight from 8pm until 3am, the Kettering Police Department will be conducting an enhanced enforcement event.  The “sting” will target DUI offenders and will be similar to the previous efforts.  As reported in the Dayton Daily News,”the Task Force chose tonight rather than Saturday night for enforcement because, in recent years, there have been fewer drivers on New Year’s Eve.”  Expect extra patrols and saturation patrols looking for signs of impaired driving.

DUI Patrols To Increase For New Year

Today the Ohio State Highway Patrol issued a statement on its web site announcing its “Drive Sober or Get Pulled Over” efforts will be stepped up throughout the New Year Holiday.  The statement reads, “[w]ith the upcoming New Year’s Holiday, the Patrol is urging motorists to not get behind the wheel impaired. During last year’s holiday reporting period of Midnight on December 30, 2010, through 11:59 p.m. on January 2, 2011 – 10 people lost their lives on Ohio’s roadways, with 70 percent of these deaths involving an impaired driver.”

The 47 Types & 38 Causes of Nystagmus; (It’s Not Just Caused by Alcohol)

The horizontal gaze nystagmus test is an eye test approved by the National Highway Traffic Safety Administration(hereinafter NHTSA) as a tool to detect clues of impairment in drivers. The HGNtest is one of three psychomotor tests approved as part of the standardized field sobriety testing protocol employed by law enforcement officers throughout the United States and used here in Ohio. The HGN is a test of your eyes wherein the testing officer is looking for abnormal movements call saccades.  These movements make the eye appear to bounce or wobble.  The officer uses this movement to make a correlation to alcohol use.  This would valid only if we are able to demonstrate that nystagmus is specific to alcohol impairment.  However, we know that there are other causes of nystagmus.  It is up to your DUI lawyer to demonstrate another valid reason for what the officer is observing.  You can find information about the Horizontal Gaze Nystagmus test and its biases on this site.

Ohio State Highway Patrol Reports A Safe Holiday Weekend

During this past holiday reporting period of Midnight, December 23 through 11:59 a.m. on December 26, eight people were killed, with one death attributed to impaired driving. This represents a nearly 43 percent decline in fatalities from last year when 14 people were killed and the lowest amount of Christmas Holiday fatalities in the past four years. Ohio is on pace to see a decline in the number of people killed on Ohio’s roadways in 2011, after experiencing a spike to 1,080 last year. Ohio experienced a record low in 2009 with 1,022 fatalities. So for this year, reports indicate 963 confirmed deaths and an additional 47 provisional unconfirmed deaths, for a total worst case scenario of 1,010 traffic deaths with five days still remaining in 2011.
