The 9th District Court of Appeals issued a great decision on the issue of substantial compliance. Specifically, the issue involved giving the HGN test while the Defendant was seated in the car. The Court found that this was not substantial compliance. (State v. Haneberg 5/29/2007, 2007-Ohio-2561, 9th District Court of Appeals).
