Lima, Allen County Checkpoint Tonight (October 22, 2011)

The Ohio State Highway Patrol will be conducting an OVI sobriety checkpoint tonight (October 22, 2011) in Allen County along Rt. 81. The checkpoint will be from 9 p.m. to midnight.  Saturation patrols will be conducted in conjunction with the checkpoints.

If you are arrested for OVI in Lima or anywhere in Allen County, Ohio, your misdemeanor drunk driving case will be heard in the Lima Municipal Court. The Lima Municipal Court is located at 109 N. Union St. in downtown Lima, Ohio and maintains the hours of 8:00 a.m. to 5:00 p.m., Monday through Friday [directions HERE].  The judges who will hear your case are the honorable William G. Lauber or the honorable Richard A. Handling Cases in Warren County For Over 16 Years

If you are arrested for misdemeanor DUI (now called OVI; operating a vehicle while impaired) in Warren County, your case will be heard in the Warren County Court.  Located at 550 Justice Drive, Lebanon, Ohio 45036, the Warren County Court has jurisdiction over misdemeanor offenses (including misdemeanor DUI’s) arising in the following villages: Harveysburg, Maineville, Morrow, South Lebanon, Springboro and Waynesville, along with the following townships: Clearcreek, Hamilton, Harlan, Massie, Salem, Union, Washington and Wayne.  Note, however, that the city of Springboro operates the Springboro Mayor’s Court.  The Warren County Court is open Monday through Friday, 8:00 a.m. to 4:30 p.m. excluding holidays and can be reached at (513) 695-1370.  Your Warren County Court DUI will be heard by the Honorable Donald E. H.B. 86 Brings Changes To Ohio’s OVI Law

House Bill 86 which will come into effect at the end of September is a significant change to the way Ohio sentences offenders.  It also holds some interesting provisions for OVI offenders, some of which we will look at here.

LOCAL INCARCERATION OPTIONS

H.B. 86 authorizes the creation of community alternative sentencing centers (CASC at R.C. 307.932 and R.C. 2929.26(B)) for midemeanants including OVI offenders.  Eligible offenders include those OVI offenders who are eligible to be sentenced directly to the CASC and who are not serving or sentenced under any other jail or prison term.  OVI offenders will also be required to meet the requirements and rules of the CASC. R.C. 307.932(C).  Those serving an OVI-related term of incarceration (including house arrest) can serve up to 60 days in the CASC and those that receive a sentence longer than 60 days are eligible to serve up to 60 days in the CASC (R.C. 307.932(C)(2).

WORK RELEASE

The bill allows for approved work, vocational education and other releases including for offenders serving mandatory OVI-related time. R.C. 307.932(H)(4)(D).

Clinton County & Hillsboro OVI Checkpoint (Sept. 24, 2011)

There will be an OVI checkpoint tonight in Wilmington, Clinton County, Ohio at Rombach Ave., near Lowes Rd.  The Clinton County Post of the Ohio State Highway Patrol will be conducting this checkpoint.
