DUI on a Bicycle

Where you ride your bicycle will determine whether or not you can be charged with an Ohio DUI.

Ohio’s drunk driving statute (O.R.C. 4511.19) prohibits operating a vehicle under the influence “anywhere in the state.”  This makes the DUI statute unique because offenses such as driving under suspension (O.R.C. 4507.02) and driving without a license (O.R.C. 4510.12) require the offense to occur on a public highway or on areas open to the public.  In State v. Carr, 1999 WL 1314672 (Ohio Ct. App. 11th Dist. Lake County 1999), a person was convicted of drunk driving in his own back yard.  But a statutory exception exists for bicycles.

O.R.C. 4511.52 limits the applicability of the drunk driving statute to operation “upon a highway or upon any path set aside for the exclusive use of bicycles.  The private property exemption for bicycles was upheld in State v. Wahl, 2003-Ohio-849 wherein a DUI conviction was vacated because the court found that a grassy area between a parking lot and a sidewalk was not a highway, nor was it set aside for the exclusive use of bicycles.

Springfield DUI Update: Clark County OVI Checkpoint on March 18, 2011

There will be a multi-agency OVI checkpoint tonight from 9:00 to midnight somewhere in Springfield, Clark County, Ohio.  The location for the checkpoint will not be released until after 5pm.  Due to logistics I will not be able to update this post, but will post the location on Twitter (@DaytonDUI) and on facebook (www.facebook.com/DaytonDUI).  See the recent post on our TEXT ALERT service which will send you a text on all relevant DUI topics like saturation patrols, traffic initiatives and OVI checkpoints.

The Clark County OVI Task Force is a coalition of 13 area agencies formed last year following a $136,000 grant from the Ohio Traffic Safety Office.  The task force is made up of the Health District, Springfield Police Division, Clark County Sheriff’s Office, Ohio Highway Patrol, Ohio Department of Transportation, Clark County EMA, Springfield Fire and Rescue Box 27, Ohio Investigative Unit and police departments in North Hampton, Enon, South Charleston, Tremont City and German Twp.

Charles M. Springfield DUI Checkpoint Tonight (Feb 11, 2011)

There will be a sobriety checkpoint tonight according to the Clark County OVI Task Force. The checkpoint will begin at 11 p.m. and will be located at state Route 40 and U.S. Route 68 in front of Snyder Park, according to the release. The checkpoint will be carried out by the Clark County OVI Task Force, a coalition funded by a $136,000 grant from the Ohio Traffic Safety Office. The task force is comprised of the Clark County Combined Health District, Clark County Sheriff’s Office, Springfield Police Division, Ohio Highway Patrol, the Ohio Department of Transportation, Clark County EMA, Springfield Fire and Rescue Box 27, Ohio Investigative Unit and police departments in North Hampton, Enon, South Charleston, Tremont City and German Twp.
